Welcome to Rosamund Muir and thank you for using our website https://rosamundmuir.com These Terms and Conditions, together with our Privacy Policy tells you the information you need to know about ordering Rosamund Muir footwear including ordering the products, refunds and returns and how we collect and use your personal information when ordering any shoe product.

These Terms will apply to any sale of products to you. Please read these Terms carefully and make sure you understand them before you order any products from our website. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any products.

You should print or save a copy of these Terms for future reference.

We amend these Terms from time to time so please read the Terms carefully before placing any orders on our Website. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.  Any questions about these Terms or ordering the products please send an email to contact@rosamundmuir.com and we will respond to your query within 24 hours.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics and logos. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

Before you purchase any of our products or if you want to use some of the other services offered on our website, you will need to create a Rosamund Muir account. This is done by completing the registration form on our Website.

You are responsible for maintaining the confidentiality of your username and password.

ELIGIBILITY TO MAKE PURCHASES

By placing an order through our rosamundmuir.com, you warrant that:

  • you are legally capable of entering into binding contracts; and
  • you are at least 18 years old. 

 

ORDERING THE PRODUCTS

Our shopping pages will guide you through the steps you need to place an order with us for our products. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process.

All orders are subject to acceptance by us, and availability, and items left in your shopping basket are not reserved and may be purchased by other customers.

Once you have made your selection and you have placed an order, you will receive an e-mail from us acknowledging that we have received your order. This email received is a confirmation of your order.

We will confirm our acceptance to you by sending you an e-mail that confirms that the products have been dispatched.

We reserve the right not to process your order in the event, for example, that we are unable to obtain authorisation for payment, or the item ordered is out of stock or we cannot meet your requested delivery date or that you do not meet the eligibility criteria set out within the Terms. We will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount including any delivery costs charged as soon as possible and in any event within 30 days.

GIFT CARDS, VOUCHERS OR GIFT CERTIFICATES POLICY (electronic or printed)

Rosamund Muir Limited Gift Cards and Gift Vouchers (including products branded as Gift Certificates), in physical (printed) or electronic forms (eGift Cards, eGift Vouchers), may only be purchased on the website www.rosamundmuir.com

The value of your Rosamund Muir eGift Card/Gift Voucher can be redeemed online at www.rosamundmuir.com for any product sold online at www.rosamundmuir.com as full payment or part payment of a product.

You can use your eGift Card/Gift Voucher only once and the total value of the products you are purchasing must be equal to or greater than the value of the eGift Card/Gift Voucher.

If the value of the product is more than the e-gift Card/Gift Voucher, you can also use a credit card to complete the transaction.

If the products purchased online total less than the value of your eGift Card/Voucher, any balance remaining on the eGift card will be lost.

In order to redeem an eGift Card/Gift Voucher via Shop at www.rosamundmuir.com you will need to enter the code number appearing on the eGift Card/Gift Voucher you received in the designated area on the Checkout page on the website. Or you can click on ”Redeem” from the email message containing the eGift Card/Gift Voucher to automatically assign the code to your browser session.

The eGift Card/Gift Voucher balance cannot be exchanged for cash or redeemed against the purchase of another eGift Card/Gift Voucher, nor can it be reloaded, resold, transferred for value, used for unauthorised commercial purposes, including to facilitate the resale or shipment of goods from www.rosamundmuir.com.

We reserve the right to refuse to accept an eGift Card/Gift Voucher which we deem to be tampered with, duplicated or which otherwise is suspected to be affected by fraud.

Please protect your eGift Card/Voucher and treat it as cash; we are not responsible if any eGift Card/Voucher is lost, stolen, destroyed or used without your permission.

Gift Cards/Gift Vouchers, eGift Cards/Gift Vouchers, Gift Certificates and any other promotional forms established in the Terms & Conditions, are valid for up to 24 months from purchase. We will not refund any balance remaining and we will invalidate the card.

eGift Cards/Vouchers have a maximum value of £500.

If you place an order with www.rosamundmuir.com using an eGift Card/Voucher and subsequently cancel the order before delivery, we will issue you another eGift Card/Voucher with the same amount as the initial one received/purchased in your name. This does not affect your statutory rights.

In case of a Return of an order that falls within the grounds specified in the Return Policy and is accepted, we will issue you another eGift Card/Voucher with the same amount as the initial one received/purchased in your name.

We reserve the right to amend the eGift card/Gift Voucher Terms and Conditions from time to time, where we consider it reasonable and necessary to do so.

CANCELLATION AND RETURNS 
 

As a consumer, you have legal rights to:

• Change your mind and withdraw from the sale contract for any reason within fourteen days from the date on which you received the products. In such case, you shall notify the Vendor by email contact@rosamundmuir.com of this intention within fourteen days of receipt to receive details of how and where to return the Product. See section 1 below, including the exceptions to this right; or

• Reject product(s) in certain circumstances, for example because they are faulty or not as described. In such case, you shall notify the Vendor by email at contact@rosamundmuir.com within fourteen days from the date on which you received the products to receive details of how and where to return the Product.

1. Right of withdrawal

Once you have exercised your right to withdraw from the sale contract by email as described above, you must return the products to us without undue delay and in any event not later than fourteen days from the date on which you received the products. Please see section 2 below for details of your return options.

2. Procedure for returning products

Upon processing of your return request email we will provide you with the address for returns as well as a returns label and instructions on how to use it.

If you return the item to us at your own cost (except where you are exercising your legal rights to reject products – for example because they are faulty or not as described) we will issue you with a full refund.

3. Compliance checks for returned product(s)

Please make sure you look after the product(s), we want our shoes to look fabulous on you! Any shoes should be handled carefully and tried on indoors on a carpeted surface. When exercising your right of withdrawal in accordance with section 1 above, you will be liable for any decrease in value of the product(s) returned to us resulting from any handling of them/use of them other than what is necessary to verify their nature, characteristics and functioning.  We may reduce your refund to reflect such decrease in value, up to the total amount you paid for the relevant product(s). For example we may make a reduction in the following circumstances:

•    the product(s) have been used, worn, damaged or washed; and/or
•    you have not returned any packaging which is an integral part of a product (such as a dust bag).

You will be contacted if we propose to reduce your refund for this reason. In this instance, you may (as an alternative to receiving a reduced refund) choose to have the products sent back to you at your own expense.

Rosamund Muir does not assume any responsibility for items returned by mistake or items not related to the return left in the packaging or in the returned items.

4. Reimbursement

Subject to the above, we will make reimbursement without undue delay, and not later than:

  • 30 days after the day we receive back from you any of the products supplied; or
  • if no products were supplied, 30 days after the day on which we are informed about your cancellation.

We will refund you using the same means of payment as you used for the initial transaction, unless this has been expressly agreed between you and us; in any event you will not incur any fees as a result of the reimbursement.

Please note you may only use your right to cancel the order as set out above if you give us written notice of cancellation any time after your order has been placed, up to 14 calendar days from the day after you receive your order, by email as described above.

In respect of any products that are faulty or mis-described you have up to 14 calendar days from the day after you receive your order to return the Products.  We will refund the price of the products in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the products to us. Please note that all products go through a thorough check for quality immediately before they are sent to you. 

 

Prices for our products may change from time to time, but changes will not affect any order you have already placed.

The price of a product includes VAT at the applicable current rate chargeable. 

The price of a product includes worldwide delivery charges. Duties in some countries will need to be paid by the customer on delivery. Our delivery charges are as advised to you during the check-out process, before you confirm your order.

If you are a customer whose credit/debit card is not denominated in Sterling/Euros, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

HOW TO PAY

We accept all major credit and debit cards, and any other methods which may be clearly advertised on the website from time to time. Payment will be debited and cleared from your account upon your placement of your order. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Payment for the products and all applicable delivery charges is at the time you place your order in the products.

If any of the products are out of stock, you will be refunded in full.

YOUR RIGHTS

You have certain rights in relation to the products under English law. These include:

  • that any products you buy from us will be of satisfactory quality, fit for their intended purpose and will conform to any description given on the website
  • certain remedies if a product is faulty; and
  • a right to cancel any order for a product within 14 days as set out above (see above).

You agree not to use the products for any commercial, business or resale purposes, and we have no liability to you for any:

  • loss of profit;
  • loss of business;
  • business interruption; or
  • loss of business opportunity

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or difficulty of the use of railways, shipping, aircraft, motor transport or other means of public or private transport or change in law affecting the supply of the Products.

If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms:

  • we will contact you as soon as possible to notify you; and
  • our obligations under these Terms will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

You may cancel the order if an Event Outside Our Control has continued for more than 30 days. To cancel in these circumstances please contact us at contact@rosamundmuir.com
